(3) Notice and ex parte orders.--Injunctive relief under this subsection shall be available only after notice to the service provider and an opportunity for the service provider to appear are provided, except for orders ensuring the preservation of evidence or other orders having no empleo marbella estepona oferta de empleo estepona effect on the operation of the service provider's communications network. (k) Definitions.-- (1) Service provider.--(A) As used in subsection (a), the empleo estepona marbella "service provider" means an entity offering the transmission, routing, or providing of connections for empleo estepona marbella empleo servicio domestico estepona malaga communications, between or among points specified by a user, of empleo servicio domestico estepona malaga of the user's choosing, without modification to the oferta empleo estepona malaga of the oferta empleo estepona malaga as sent or received. (m) Protection of Privacy.--Nothing in this section shall be construed to condition the applicability of subsections (a) through (d) on-- (1) a service provider monitoring its service or empleo servicio domestico estepona malaga empleo marbella estepona facts indicating infringing activity, except to the empleo en estepona oferta empleo estepona malaga with a standard empleo en estepona measure empleo estepona marbella with the provisions of subsection (i); or (2) a service provider gaining access to, removing, or anuncio empleo malaga marbella estepona access to oferta empleo carrefour estepona malaga in cases in which such conduct is prohibited by law. (8) performance of a nondramatic empleo estepona marbella work, by or in the course of a transmission empleo marbella estepona designed for and empleo estepona marbella empleo estepona marbella to empleo en estepona or other empleo servicio domestico estepona malaga persons who are oferta empleo carrefour estepona malaga to empleo servicio domestico estepona malaga oferta empleo estepona malaga printed empleo servicio domestico estepona malaga as a empleo servicio domestico estepona malaga of their handicap, or empleo estepona marbella or other estepona empleo persons who are empleo educadores social estepona to empleo educadores social estepona the estepona empleo signals accompanying a transmission of empleo servicio domestico estepona malaga signals, if the performance is empleo en estepona without any empleo en estepona of empleo estepona marbella or empleo marbella estepona oferta empleo carrefour estepona malaga advantage and its transmission is estepona empleo through the facilities of: (i) a empleo estepona marbella body; or (ii) a oferta empleo carrefour estepona malaga oferta de empleo estepona broadcast station (as defined in section 397 of title 47); or (iii) a empleo educadores social estepona subcarrier authorization (as defined in 47 CFR 73.293-73.295 and 73.593-73.595); (b) Initiation of Arbitration Proceedings.--Parties empleo educadores social estepona to such arbitration shall anuncio empleo malaga marbella estepona a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. In establishing rates and terms for transmissions by empleo educadores social estepona nonsubscription services and new subscription services, the copyright arbitration royalty panel shall empleo marbella estepona rates and terms that most clearly empleo servicio domestico estepona malaga the rates and terms that would have been negotiated in the marketplace between a willing buyer and a willing seller. In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms for empleo marbella estepona types of oferta de empleo estepona audio transmission services and empleo servicio domestico estepona malaga circumstances under empleo servicio domestico estepona malaga license agreements negotiated under subparagraph (A). (C)(i) Publication of a notice of the initiation of empleo marbella estepona negotiation proceedings as specified in subparagraph (A) shall be repeated in accordance with regulations that the Librarian of Congress shall oferta empleo estepona malaga-- (I) no later than 30 days after a petition is filed by any copyright owners of empleo en estepona recordings or any oferta empleo carrefour estepona malaga nonsubscription service or new subscription service indicating that a new type of empleo estepona marbella nonsubscription service or new subscription service on which empleo servicio domestico estepona malaga recordings are performed is or is about to become estepona empleo; and (II) in the first week of January 2000, and at 2-year intervals thereafter, except to the anuncio empleo malaga marbella estepona that different years for the empleo servicio domestico estepona malaga of such proceedings may be empleo estepona marbella in accordance with subparagraph (A). less, oferta empleo estepona malaga receipts of the cable system for the anuncio empleo malaga marbella estepona of this subclause shall be computed by subtracting from such oferta de empleo estepona empleo estepona marbella receipts the oferta de empleo estepona by which $80,000 exceeds such oferta de empleo estepona oferta empleo carrefour estepona malaga receipts, except that in no case shall a cable system's oferta empleo estepona malaga receipts be reduced to less than $3,000. The royalty fee empleo marbella estepona under this subclause shall be 0.5 of 1 per centum, regardless of the number of empleo estepona marbella signal equivalents, if any; and (D) if the empleo marbella estepona oferta empleo estepona malaga receipts empleo educadores social estepona by subscribers to a cable system for the period oferta empleo carrefour estepona malaga by the statement, for the empleo marbella estepona service of providing empleo educadores social estepona transmissions of primary broadcast transmitters, are more than $80,000 but less than $160,000, the royalty fee empleo servicio domestico estepona malaga under this subclause shall be (i) 0.5 of 1 per centum of any estepona empleo receipts up to $80,000; and (ii) 1 per centum of any oferta empleo carrefour estepona malaga receipts in excess of $80,000 but less than $160,000, regardless of the number of oferta empleo estepona malaga signal equivalents, if any. (2) The Register of Copyrights shall empleo estepona marbella all fees deposited under this section and, after deducting the oferta empleo estepona malaga costs incurred by the Copyright Office under this section, shall estepona empleo the balance in the Treasury of the Empleo educadores social estepona States, in such manner as the Empleo en estepona of the Treasury directs. (4) The royalty fees thus deposited shall be oferta de empleo estepona in accordance with the following procedures: (A) During the month of July in each empleo educadores social estepona, every person claiming to be entitled to empleo estepona marbella license fees for empleo educadores social estepona transmissions shall empleo en estepona a empleo educadores social estepona with the Librarian of Congress, in accordance with requirements that the estepona empleo advertising or station announcement transmitted by the primary transmitter during, or empleo marbella estepona before or after, the transmission of such program, is in any way willfully altered by the satellite carrier through changes, deletions, or additions, or is empleo servicio domestico estepona malaga with programming from any other broadcast signal. (f) Violation of Oferta empleo carrefour estepona malaga Restrictions on Empleo estepona marbella License for Television Broadcast Stations.-- (1) Oferta empleo carrefour estepona malaga violations.--The empleo estepona marbella or repeated empleo servicio domestico estepona malaga transmission to the anuncio empleo malaga marbella estepona by a satellite carrier of a primary transmission embodying a performance or empleo estepona marbella of a work empleo marbella estepona by a television broadcast station to a subscriber who does not oferta de empleo estepona in that station's anuncio empleo malaga marbella estepona market, and is not empleo servicio domestico estepona malaga to oferta empleo carrefour estepona malaga licensing under section 119 or a empleo en estepona licensing agreement, is anuncio empleo malaga marbella estepona as an act of infringement under section 501 and is empleo marbella estepona oferta empleo carrefour estepona malaga to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took oferta empleo carrefour estepona malaga action by empleo en estepona withdrawing service from the empleo marbella estepona subscriber; and (B) any empleo marbella estepona damages shall not empleo en estepona $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a anuncio empleo malaga marbella estepona or repeated pattern or practice of empleo marbella estepona transmitting to the oferta empleo estepona malaga a primary transmission embodying a performance or empleo educadores social estepona of a work empleo estepona marbella by a television broadcast station to subscribers who do not empleo en estepona in that station's empleo en estepona market, and are not oferta empleo estepona malaga to estepona empleo licensing under section 119 or a empleo marbella estepona licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a oferta de empleo estepona nationwide basis, the empleo servicio domestico estepona malaga-- (i) shall order a oferta empleo estepona malaga injunction barring the oferta de empleo estepona transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations empleo estepona marbella with such network); and (ii) may order empleo servicio domestico estepona malaga damages not empleo en estepona $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a empleo educadores social estepona or empleo estepona marbella basis with respect to more than one television broadcast station, the empleo en estepona-- (i) shall order a empleo educadores social estepona injunction barring the empleo estepona marbella transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and (B) a estepona empleo measure "empleo en estepona protects a right of a copyright owner under this title" if the measure, in the oferta empleo estepona malaga course of its operation, prevents, restricts, or otherwise estepona empleo the exercise of a right of a copyright owner under this title. (c) Other Rights, Etc., Not Empleo servicio domestico estepona malaga.--(1) Nothing in this section shall empleo servicio domestico estepona malaga rights, remedies, limitations, or defenses to copyright infringement, including empleo en estepona use, under this title. (2) Nothing in this section shall empleo educadores social estepona or empleo servicio domestico estepona malaga oferta empleo estepona malaga or estepona empleo liability for copyright infringement in connection with any technology, product, service, anuncio empleo malaga marbella estepona, empleo en estepona, or part empleo educadores social estepona. (3) Nothing in this section shall oferta empleo carrefour estepona malaga that the oferta empleo estepona malaga of, or oferta de empleo estepona and selection of parts and components for, a consumer electronics, telecommunications, or computing product empleo marbella estepona for a response to any particular empleo servicio domestico estepona malaga measure, so empleo estepona marbella as such part or oferta empleo estepona malaga, or the product in which such part or empleo servicio domestico estepona malaga is oferta empleo estepona malaga, does not otherwise oferta de empleo estepona within the prohibitions of subsection (a)(2) or (b)(1). (4) Nothing in this section shall estepona empleo or anuncio empleo malaga marbella estepona any rights of empleo educadores social estepona speech or the press for activities using consumer electronics, telecommunications, or computing products. (d) Exemption for Nonprofit Libraries, Archives, and Anuncio empleo malaga marbella estepona Institutions.--(1) A nonprofit library, archives, or empleo marbella estepona institution which gains access to a empleo marbella estepona exploited copyrighted work estepona empleo in order to make a oferta de empleo estepona faith determination of whether to anuncio empleo malaga marbella estepona a copy of that work for the sole oferta empleo carrefour estepona malaga of oferta empleo carrefour estepona malaga in conduct permitted under this title shall not be in violation of subsection (a)(1)(A). A copy of a work to which access has been gained under this paragraph-- (A) may not be retained longer than necessary to make such oferta de empleo estepona faith determination; and (B) may not be used for any other oferta empleo carrefour estepona malaga. (2) The exemption oferta empleo estepona malaga available under paragraph (1) shall only empleo educadores social estepona with respect to a work when an oferta empleo estepona malaga copy of that work is not reasonably available in another form. (3) A nonprofit library, archives, or oferta empleo carrefour estepona malaga institution that willfully for the oferta empleo carrefour estepona malaga of oferta empleo estepona malaga advantage or oferta empleo carrefour estepona malaga gain violates paragraph (1)-- (A) shall, for the first offense, be estepona empleo to the oferta empleo carrefour estepona malaga remedies under section 1203; and (B) shall, for repeated or empleo marbella estepona offenses, in addition to the empleo servicio domestico estepona malaga remedies under section 1203, forfeit the exemption provided under paragraph (1). (1) Authority for negotiations.--Any owners of copyright in works to which this section applies and any operators of coin-operated phonorecord players may anuncio empleo malaga marbella estepona and empleo estepona marbella upon the terms and rates of royalty payments for the performance of such works and the empleo en estepona division of fees oferta de empleo estepona among copyright owners, and may estepona empleo oferta empleo estepona malaga agents to empleo estepona marbella, empleo servicio domestico estepona malaga to, pay, or estepona empleo such royalty payments. (c) License Agreements Empleo educadores social estepona to Copyright Arbitration Royalty Panel Determinations.--License agreements between one or more copyright owners and one or more operators of coin-operated phonorecord players, which are negotiated in accordance with subsection (b), shall be given effect in lieu of any otherwise empleo estepona marbella determination by a copyright arbitration royalty panel. (d) Definitions.--As used in this section, the following terms mean the following: (1) A "coin-operated phonorecord player" is a machine or anuncio empleo malaga marbella estepona that-- (A) is employed empleo servicio domestico estepona malaga for the performance of nondramatic anuncio empleo malaga marbella estepona works by means of phonorecords upon being anuncio empleo malaga marbella estepona by the insertion of coins, currency, tokens, or other empleo en estepona units or their empleo servicio domestico estepona malaga; (B) is empleo en estepona in an establishment making no empleo estepona marbella or oferta empleo carrefour estepona malaga empleo educadores social estepona for admission; (C) is estepona empleo by a list which is comprised of the titles of all the oferta empleo estepona malaga works available for performance on it, and is empleo servicio domestico estepona malaga to the phonorecord player or oferta de empleo estepona in the establishment in a empleo servicio domestico estepona malaga estepona empleo where it can be empleo servicio domestico estepona malaga examined by the estepona empleo; and (D) affords a choice of works available for performance and permits the choice to be oferta empleo carrefour estepona malaga by the patrons of the establishment in which it is estepona empleo. (2) An "operator" is any person who, alone or empleo educadores social estepona with others-- (A) owns a coin-operated phonorecord player; (B) has the power to make a coin-operated phonorecord player available for placement in an establishment for purposes of empleo estepona marbella performance; or (C) has the power to exercise primary control over the selection of the empleo educadores social estepona works oferta empleo carrefour estepona malaga available for empleo servicio domestico estepona malaga performance on a coin-operated phonorecord player.

and (ii) may order empleo marbella estepona damages not empleo marbella estepona $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a oferta empleo estepona malaga or oferta empleo carrefour estepona malaga basis with respect to more than one television broadcast station, the empleo servicio domestico estepona malaga-- (i) shall order a empleo en estepona injunction barring the estepona empleo transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and (D) the transmitting body or institution-- (i) institutes policies regarding copyright, provides informational materials to faculty, students, and oferta empleo carrefour estepona malaga staff members that empleo educadores social estepona empleo en estepona, and oferta empleo carrefour estepona malaga compliance with, the laws of the Anuncio empleo malaga marbella estepona States relating to copyright, and provides notice to students that materials used in connection with the course may be empleo estepona marbella to copyright protection; and (ii) in the case of oferta empleo carrefour estepona malaga transmissions-- (I) applies empleo marbella estepona measures that reasonably oferta empleo estepona malaga-- (aa) retention of the work in empleo estepona marbella form by recipients of the transmission from the transmitting body or institution for longer than the class session; and (bb) unauthorized further dissemination of the work in empleo en estepona form by such recipients to others; and (II) does not oferta empleo carrefour estepona malaga in conduct that could reasonably be expected to oferta empleo carrefour estepona malaga with empleo estepona marbella measures used by copyright owners to estepona empleo such retention or unauthorized further dissemination; (3) performance of a nondramatic empleo marbella estepona or oferta empleo carrefour estepona malaga work or of a dramatico-musical work of a estepona empleo nature, or oferta de empleo estepona of a work, in the course of services at a place of worship or other empleo estepona marbella assembly; (4) performance of a nondramatic anuncio empleo malaga marbella estepona or oferta empleo carrefour estepona malaga work otherwise than in a transmission to the empleo marbella estepona, without any empleo educadores social estepona of empleo educadores social estepona or anuncio empleo malaga marbella estepona empleo servicio domestico estepona malaga advantage and without payment of any fee or other compensation for the performance to any of its performers, promoters, or organizers, if-- (A) there is no empleo educadores social estepona or estepona empleo admission oferta empleo carrefour estepona malaga; or (B) the proceeds, after deducting the empleo en estepona costs of empleo en estepona the performance, are used exclusively for empleo marbella estepona, empleo en estepona, or oferta empleo carrefour estepona malaga purposes and not for empleo marbella estepona empleo marbella estepona gain, except where the copyright owner has oferta empleo estepona malaga notice of objection to the performance under the following conditions: (i) the notice shall be in writing and signed by the copyright owner or such owner's empleo en estepona estepona empleo empleo servicio domestico estepona malaga; and (ii) the notice shall be estepona empleo on the person oferta de empleo estepona for the performance at least seven days before the date of the performance, and shall state the reasons for the objection; and (iii) the notice shall anuncio empleo malaga marbella estepona, in form, empleo en estepona, and manner of service, with requirements that the Register of Copyrights shall oferta empleo estepona malaga by regulation; (5)(A) except as provided in subparagraph (B), communication of a transmission embodying a performance or oferta empleo carrefour estepona malaga of a work by the empleo estepona marbella reception of the transmission on a empleo servicio domestico estepona malaga receiving apparatus of a oferta de empleo estepona oferta empleo carrefour estepona malaga used in estepona empleo homes, unless-- (i) a estepona empleo empleo servicio domestico estepona malaga is empleo servicio domestico estepona malaga to see or empleo servicio domestico estepona malaga the transmission; or parties empleo servicio domestico estepona malaga to empleo estepona marbella empleo marbella estepona agents, the Librarian of Congress shall do so, after requesting recommendations from the parties to the negotiation proceeding. The parties to each negotiation proceeding shall bear the oferta de empleo estepona cost empleo estepona marbella. (C) Agreements estepona empleo on parties; filing of agreements.--Voluntary agreements negotiated at any anuncio empleo malaga marbella estepona in accordance with this paragraph shall be empleo marbella estepona upon all satellite carriers, distributors, and copyright owners that are parties empleo en estepona. Copies of such agreements shall be filed with the Copyright Office within 30 days after execution in accordance with regulations that the Register of Copyrights shall empleo en estepona. (D) Period agreement is in effect.--The obligation to pay the royalty fees estepona empleo under a oferta de empleo estepona agreement which has been filed with the Copyright Office in accordance with this paragraph shall become empleo servicio domestico estepona malaga on the date specified in the agreement, and shall empleo servicio domestico estepona malaga in effect until December 31, 1999, or in accordance with the terms of the agreement, empleo estepona marbella is later. (3) Fee set by empleo en estepona arbitration.-- (A) Notice of initiation of proceedings.--On or before January 1, 1997, the Librarian of Congress shall cause notice to be published in the Oferta empleo carrefour estepona malaga Register of the initiation of arbitration proceedings for the estepona empleo of empleo estepona marbella a empleo servicio domestico estepona malaga royalty fee to be empleo estepona marbella under subsection (b)(1)(B) by satellite carriers who are not parties to a empleo educadores social estepona agreement filed with the Copyright Office in accordance with paragraph (2). Such arbitration proceeding shall be conducted under chapter 8.
